These terms govern your use of the terrascane.com website and the TerraScane platform (the "Platform"). You accept them with the checkbox when you create an account, and by selecting "Continue" in the first notice when you start as a guest. If you have signed a separate written agreement with us for a pilot, reporting, or consulting, the provisions of that agreement take precedence.

Accounts and guest use

  • You must be at least 18 years old to use the Platform. If you create an account on behalf of an organization, you must be authorized to do so.
  • When you create an account, you must give accurate information and must not share your password with anyone. If you notice unauthorized use of your account, write to us right away.
  • As a guest, you can use the Platform in a limited way without giving an email address or password: up to 2 parcels, up to 7,500 hectares per parcel, and up to 5 analyses. A guest session is tied to your browser; if you delete your browser data, you can no longer reach your work. Guest data is deleted 14 days after last use. If you create an account while you are a guest, your analyses move to your account.

Scope of the service

On the Platform, you can draw your parcels on the map or upload them in a file (KML, KMZ, GeoJSON, Shapefile); run analyses with satellite data, such as vegetation, change, land cover, and surface temperature; and download the results as PDF, Excel, KMZ, and GeoTIFF.

Current limits:

  • a parcel can be at least 0.1 and at most 100,000 hectares, with at most 500 vertices;
  • an uploaded file can be at most 10 MB, with at most 50 parcels.

We may change the limits and the analysis types; we announce a change that affects you adversely at least 30 days in advance. Current information is on the Documentation page.

Use of the Platform under these terms is free of charge. Paid services such as pilots, reporting, and consulting are provided under a separate written agreement. If we start paid use on the Platform, we will announce its terms in advance and ask for your separate approval.

Acceptable use

When you use the Platform, you must not:

  • use it for an unlawful purpose or in a way that infringes the rights of others;
  • try to exceed the limits, get around security measures, or run security tests without permission;
  • send bulk requests with automated tools or extract the Platform's content and data in bulk;
  • copy the software, reverse engineer it, or use it to build a competing product, except where the law allows;
  • upload malware or disrupt the operation of the Platform;
  • transfer your account to someone else or share your sign-in details (each person in your organization uses their own account).

Your data

You keep the rights to the parcels and files you upload and to your analyses. So that we can provide the Platform, you give us a limited, non-transferable, royalty-free permission to store, process, back up, and show you this data; this permission ends when your account is deleted. We do not sell your data, and we use it only for the purposes stated in the Privacy policy. You can get a copy of your data with the download options on the Platform.

If you upload other people's personal data to the Platform, you are the data controller for that data: informing the people concerned and having the necessary legal ground are your obligations. We process this data only on your behalf and to provide the service.

Analysis results

Results are estimates made with satellite imagery and models. Clouds, shadows, resolution, and image availability affect the results; for some dates, no imagery may be available. Results do not replace field measurement, official records (such as land registry and cadastre), or verification by authorized bodies. In reporting processes such as carbon or EUDR, results are supporting data; the responsibility for the declaration and its verification lies with the people and organizations concerned.

Data sources and attributions

The analyses use publicly available Earth observation data:

  • Copernicus Sentinel-2 (European Union and ESA);
  • Landsat 5, 7, 8, and 9 (USGS and NASA);
  • MODIS (NASA);
  • Copernicus DEM GLO-30 (© DLR e.V. 2010-2014 and © Airbus Defence and Space GmbH 2014-2018, provided under COPERNICUS by the European Union and ESA);
  • Dynamic World (Google and World Resources Institute, CC BY 4.0);
  • Esri land cover (Esri and Impact Observatory, CC BY 4.0);
  • JRC Global Surface Water (European Commission Joint Research Centre and Google);
  • ESA WorldCover (European Space Agency, CC BY 4.0);
  • Hansen Global Forest Change (University of Maryland, CC BY 4.0) and GLAD data (University of Maryland).

Base maps: © OpenStreetMap contributors (ODbL) and OpenTopoMap (CC BY-SA). The outputs carry the attributions of these sources; you must keep the attributions when you publish or share the outputs.

Intellectual property

The rights to the Platform's software, interface, design, and texts, and to the TerraScane name and logo, belong to us and are protected by the relevant legislation, in particular Law No. 5846 on Intellectual and Artistic Works. We give you and the organization your account belongs to a non-transferable, non-exclusive right to use the Platform in line with these terms. You can use and share your outputs in your own work, reports, and presentations. Your rights to the outputs are limited by the license terms of the data sources used; you must keep the attributions.

Service availability

We do not guarantee that the Platform will run without interruption or errors. The Platform may stop temporarily because of maintenance, updates, or outages at our service providers; you can see the status of the services on the API status page. We may improve or change the Platform's features or remove a feature; we announce any significant change that affects you adversely at least 30 days in advance.

Liability

Our liability for damage caused by our intent or gross negligence, and in cases where liability cannot be limited by law, remains unaffected (Turkish Code of Obligations, Article 115). Apart from these cases, we are not liable for decisions you make based on analysis results, for indirect damage (such as loss of profit or business), for service interruptions, or for disruptions caused by force majeure, such as natural disasters, widespread infrastructure outages, or decisions of public authorities; the same applies to cyberattacks that occur despite our taking the necessary security measures. We are not responsible for the content of other websites you reach through links on the Platform. Where you qualify as a consumer, your rights under Law No. 6502 remain unaffected. You are liable for damage arising from your culpable breach of these terms.

Closing and suspending accounts

You can close your account at any time: just write to iletisim@terrascane.com from the email address registered to your account, and we will delete your account within 30 days at the latest.

If you breach these terms seriously or repeatedly, if the security of the Platform or the rights of others require it, or if a competent authority asks us to, we may suspend or close your account. We tell you this, with our reasons, in advance where possible, or right afterward if not. Unless there is unlawfulness or a security risk, we give you at least 30 days to download your data before we close your account. The Privacy policy explains what happens to your data when your account is closed.

End of the service

If we decide to shut down the Platform, we will announce it by email at least 30 days in advance and give you time to download your data.

Changes to these terms

We may change these terms. We announce a change to your disadvantage at least 15 days before it takes effect and ask for your approval the next time you sign in to the Platform. If you do not approve, you cannot continue to use the Platform; you can write to us to request a copy of your data or to close your account.

Governing law

These terms are governed by Turkish law. Where you qualify as a consumer, your right to apply to consumer arbitration committees and consumer courts under Law No. 6502 on Consumer Protection remains unaffected. If a provision of these terms is held invalid, the other provisions remain in force.

Notices and contact

We send you notices by writing to the email address registered to your account. For questions: iletisim@terrascane.com.
